History

Upon entry into force of Statute, will be the principal judicial organ of C-XC4129 - Organisation of Islamic Cooperation (OIC). Set up following decision of the 5th F-XF4974 - Islamic Summit of Kings and Heads of States and Governments, 1987, Kuwait. Statute: 29 Jan 1987. Seat in Kuwait.

Aims

Cover all cases whose reference to it is agreed by Member States and all special cases stipulated in OIC Charter or in the treaties and conventions in force and: (a) examine disputes that may arise among Member States if the parties concerned agree to submit it to the Court or if any treaty or agreement so decides; (b) examine facts which constitute breaches to international law as well as the nature and extent of legislation due to breaches of international law; (c) provide interpretation of the Charter, Treaties or agreements; (d) provide advisory legal opinion upon demand of any organ and endorsement of the Council of Foreign Ministers; (e) undertake mediation, conciliation or arbitration in disputes upon request of the concerned parties, the Summit or the Council of Foreign Ministers.

Structure

Court will comprise a panel of 7 members elected by K-XF4192 - Council of Foreign Ministers (CFM). It will elect President and Vice-President from among its members. Registrar and other personnel as necessary. To be in permanent session except for vacations.
